_module_preset=&#8221;default&#8221; custom_padding=&#8221;||0px|||&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; theme_builder_area=&#8221;post_content&#8221; sticky_enabled=&#8221;0&#8243;]<p><b><span data-contrast=\"auto\">The Soil Monitoring Law<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Soil Monitoring Law\u00a0(SML), also known as<\/span><i><span data-contrast=\"auto\">\u00a0<\/span><\/i><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2025\/2360\/oj\"><span data-contrast=\"none\">Directive (EU) 2025\/2360<\/span><\/a><span data-contrast=\"auto\">\u00a0on soil monitoring and resilience,\u00a0has been in force since December 2025. It\u00a0establishes\u00a0an\u00a0<\/span><b><span data-contrast=\"auto\">EU-wide soil health\u00a0monitoring\u00a0system<\/span><\/b><span data-contrast=\"auto\">, enhancing the availability and comparability of key soil health data. The aim is to mitigate the effects of climate change and biodiversity loss, promote food security and prepare the soil for natural disasters.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Through SML, the European Commission foresee to\u00a0<\/span><b><span data-contrast=\"auto\">ensure a level playing field and\u00a0a high level\u00a0of environmental and health protection<\/span><\/b><span data-contrast=\"auto\">. The MS shall regularly report to the Commission and the European Environment Agency (EEA) on the situation\u00a0regarding\u00a0soil health, land\u00a0use\u00a0and contaminated land, ensuring that comparable data is available across the EU and that coordinated measures can be taken to address soil degradation.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The collected data will\u00a0<\/span><b><span data-contrast=\"auto\">enable landowners to implement the most\u00a0appropriate treatment\u00a0methods<\/span><\/b><span data-contrast=\"auto\">\u00a0and will\u00a0assist\u00a0them in\u00a0maintaining\u00a0and increasing soil fertility and yields, while minimising water and nutrient consumption.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">An indicative\u00a0<\/span><b><span data-contrast=\"auto\">watchlist of emerging substances<\/span><\/b><span data-contrast=\"auto\">\u00a0that could pose a significant risk to soil health, human\u00a0health\u00a0or the environment, and for which data is needed, will be drawn up 18 months after the law enters into force (May 2027). It shall\u00a0contain\u00a0substances\u00a0such as perfluoroalkyl and polyfluoroalkyl substances (PFAS), pesticides\u00a0or\u00a0microplastics.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-ccp-props=\"{}\"><\/span><\/p>[\/et_pb_text][et_pb_image src=&#8221;https:\/\/soilprom.eu\/wp-content\/uploads\/2026\/04\/F0RpePcWwAARf4bjpeg_qKIa4aMYRFdFZVmSEWx4ps0FXDY_137836.jpg&#8221; _builder_version=&#8221;4.27.6&#8243; _module_preset=&#8221;default&#8221; theme_builder_area=&#8221;post_content&#8221; title_text=&#8221;F0RpePcWwAARf4bjpeg_qKIa4aMYRFdFZVmSEWx4ps0FXDY_137836&#8243; width=&#8221;53%&#8221; module_alignment=&#8221;center&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;][\/et_pb_image][\/et_pb_column][\/et_pb_row][et_pb_row _builder_version=&#8221;4.27.6&#8243; _module_preset=&#8221;default&#8221; theme_builder_area=&#8221;post_content&#8221;][et_pb_column _builder_version=&#8221;4.27.6&#8243; _module_preset=&#8221;default&#8221; type=&#8221;4_4&#8243; theme_builder_area=&#8221;post_content&#8221;][et_pb_text _builder_version=&#8221;4.27.6&#8243; _module_preset=&#8221;default&#8221; theme_builder_area=&#8221;post_content&#8221; hover_enabled=&#8221;0&#8243; sticky_enabled=&#8221;0&#8243;]<p><b><span data-contrast=\"auto\">What measures for landowners and land managers?<\/span><\/b><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">To protect farmers and foresters, the Directive does not impose\u00a0<\/span><b><i><span data-contrast=\"auto\">any<\/span><\/i><\/b><span data-contrast=\"auto\">\u00a0new obligations on landowners or land managers.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Instead, the SML establishes support measures that may include\u00a0<\/span><b><span data-contrast=\"auto\">independent advice<\/span><\/b><span data-contrast=\"auto\">,\u00a0<\/span><b><span data-contrast=\"auto\">training activities<\/span><\/b><span data-contrast=\"auto\">, and\u00a0<\/span><b><span data-contrast=\"auto\">capacity building<\/span><\/b><span data-contrast=\"auto\">, as well as the\u00a0<\/span><b><span data-contrast=\"auto\">promotion of research and innovation<\/span><\/b><span data-contrast=\"auto\">, and measures to\u00a0<\/span><b><span data-contrast=\"auto\">raise awareness of the benefits of sustainable practices,\u00a0<\/span><\/b><span data-contrast=\"auto\">and of soil resilience. MS shall map the\u00a0<\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52023SC0423&amp;qid=1706626410947\"><span data-contrast=\"none\">available funding opportunities<\/span><\/a><span data-contrast=\"auto\">\u00a0for landowners and managers. Member States will also have to\u00a0assess regularly\u00a0the financial cost to farmers and foresters&#8217; of improving soil health and soil resilience.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Moreover, the monitoring activities fall under the full responsibility of the Member States and their public authorities.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Soil Monitoring Law requires\u00a0<\/span><b><i><span data-contrast=\"auto\">no monitoring whatsoever<\/span><\/i><\/b><span data-contrast=\"auto\">\u00a0<\/span><b><span data-contrast=\"auto\">from landowners and managers themselves<\/span><\/b><span data-contrast=\"auto\">\u00a0and therefore also\u00a0doesn\u2019t\u00a0require them to carry any of the costs. This is also explicitly clarified in a new\u00a0<\/span><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2025\/2360\/oj\"><span data-contrast=\"none\">Recital\u00a0(36)<\/span><\/a><span data-contrast=\"auto\">\u00a0that states that soil health monitoring under this Directive should not create any financial burden on landowners and land managers.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">SML includes specific provisions that\u00a0<\/span><b><span data-contrast=\"auto\">prevent soil health data collected\u00a0in accordance with\u00a0<\/span><\/b><a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2025\/2360\/oj\"><b><span data-contrast=\"none\">Article 6<\/span><\/b><\/a><b><span data-contrast=\"auto\">\u00a0to be traced back to specific land parcels<\/span><\/b><span data-contrast=\"auto\">. Article 6 clearly\u00a0states\u00a0that the soil health data portal will provide access only to\u00a0<\/span><b><span data-contrast=\"auto\">data aggregated at the soil unit level<\/span><\/b><span data-contrast=\"auto\">\u00a0(and only a more detailed level if the Member States wishes).<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Soil Monitoring Law\u00a0<\/span><b><i><span data-contrast=\"auto\">does\u00a0not<\/span><\/i><\/b><span data-contrast=\"auto\">\u00a0include provisions that directly prevent the construction of infrastructure and housing or the permitting of mining or renewable energy projects. They must transpose the Directive&#8217;s provisions into their national law by 16 December 2028.
